By downloading, installing, or using the Cheeku application (the "App"), you ("User" or "You") agree to be bound by the terms and conditions set forth in this User Agreement (the "Agreement"). If you do not agree to all terms of this Agreement, you must not download, install, or use the App. This Agreement constitutes a legal agreement between you and the developer of Cheeku (the "Developer").
The App is designed to provide a minimalist, elegant time-management experience, including real-time clock display, countdown timer, and custom theme features. Your use of the App is subject to compliance with this Agreement, as well as any applicable laws and regulations in your jurisdiction.
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are 13 years of age or older, and that you have the legal capacity to enter into this Agreement. If you are using the App on behalf of a minor (between 13 and 17 years of age), you confirm that you are the minor’s parent or legal guardian, and you agree to be responsible for the minor’s compliance with this Agreement.
Important Note: If you are under 13 years of age, you are not permitted to use the App. The Developer reserves the right to terminate access to the App for any user found to be under 13 years of age, without prior notice.
The App offers three core modes to meet your timing needs, and you are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only. The key features and usage guidelines are as follows:
You agree not to use the App for any unlawful, fraudulent, or harmful purpose. Prohibited uses include, but are not limited to: (a) using the App to violate any local, state, national, or international law; (b) interfering with the App’s functionality or security (e.g., hacking, modifying the App’s code); (c) using the App to transmit spam, malware, or other harmful content; (d) reselling, renting, or licensing the App or its features to any third party; and (e) reverse-engineering, decompiling, or disassembling the App’s software.
Unlike many other applications, Cheeku does not require you to create an account or provide personal information (e.g., name, email address) to access and use its core features. You may download and use the App immediately after installation, without undergoing a registration process. This "no-account" policy is designed to protect your privacy and provide a seamless user experience.
However, if you choose to purchase additional features or themes through in-app purchases (as described in Section 5), you may be required to provide payment information through the applicable app store (e.g., Apple App Store, Google Play Store). The Developer does not collect or store your payment information; all payment processing is handled by the third-party app store, and subject to the app store’s terms of service and privacy policy.
The App offers optional in-app purchases ("IAPs") that allow you to unlock additional backgrounds, themes, and features. All IAPs are subject to the pricing and terms set forth in the applicable app store (e.g., Apple App Store, Google Play Store) at the time of purchase. By making an IAP, you agree to comply with the app store’s terms of service, as well as the following additional terms:
You acknowledge that you are solely responsible for all IAPs made using your app store account. If you believe that an unauthorized IAP has been made using your account, you must contact the applicable app store immediately to report the issue and request assistance.
All intellectual property rights in the App (including, but not limited to, software code, design elements, logos, themes, backgrounds, fonts, and text content) are owned by the Developer or its licensors. This Agreement does not transfer any intellectual property rights to you; you only receive a limited license to use the App as described in Section 3.
You may not: (a) copy, reproduce, or distribute any part of the App without the Developer’s prior written consent; (b) modify, adapt, or create derivative works based on the App; (c) remove or alter any copyright, trademark, or other proprietary notices displayed in the App; or (d) use any of the App’s intellectual property for commercial purposes without the Developer’s explicit permission.
If you believe that the App infringes on your intellectual property rights, please contact the Developer at the email address provided in Section 9 to submit a formal notice of infringement. The Developer will review your notice and take appropriate action in accordance with applicable laws.
The App is provided "as is" and "as available," without any warranties of any kind, either express or implied. The Developer disclaims all warranties, including, but not limited to: (a) implied warranties of merchantability, fitness for a particular purpose, and non-infringement; (b) warranties that the App will be error-free, uninterrupted, or secure; (c) warranties that the App will meet your specific needs or expectations; and (d) warranties regarding the accuracy, reliability, or completeness of the App’s features (including the countdown timer).
The Developer does not guarantee that the App will work on all devices or operating systems, or that it will be compatible with all third-party software or hardware. Your use of the App may be affected by factors beyond the Developer’s control, such as internet connectivity, device performance, or operating system updates. The Developer shall not be liable for any damages or losses resulting from such factors.
Limitation on Liability: To the maximum extent permitted by applicable law, the Developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including, but not limited to, loss of profits, data, or use) arising out of or in connection with your use of the App. This limitation applies regardless of whether the damages are based on contract, tort, negligence, strict liability, or any other legal theory.
The Developer reserves the right to modify or update this Agreement at any time. When the Developer makes material changes to the Agreement, it will notify you by: (a) displaying a prominent notice within the App; (b) sending a notification to your device (if you have enabled notifications); or (c) posting the updated Agreement on the App’s page in the applicable app store. The date of the last update to the Agreement will be indicated at the end of this document.
Your continued use of the App after the effective date of the modified Agreement constitutes your acceptance of the updated terms. If you do not agree to the modified Agreement, you must stop using the App and uninstall it from your device. The Developer encourages you to review this Agreement periodically to stay informed of any changes.

The Developer will make reasonable efforts to respond to your inquiry within 3-5 business days.
The Developer may terminate this Agreement and your access to the App at any time, with or without cause, by providing you with written notice (e.g., via email or in-app notification). The Developer may also terminate your access to the App immediately if you violate any material term of this Agreement (e.g., using the App for unlawful purposes, infringing on intellectual property rights).
Upon termination of this Agreement, you must stop using the App and uninstall it from all your devices. The provisions of this Agreement that by their nature should survive termination (e.g., intellectual property rights, disclaimers of warranty, limitation of liability) will continue to apply after termination.
